SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on the 3rd day of November, 2017, Julia A. Ellis, an unmarried woman, executed a certain Deed of Trust to Picayune Law, LLC, Trustee, for the benefit of Fidelity Bank, which Deed of Trust was recorded in the office of the Chancery Clerk of Pearl River County, Mississippi, and recorded in Deed of Trust Book 2017 at Page 9568 of the land records; and,
WHEREAS, Simpson Law Firm PA has been substituted in the place and stead of Picayune Law, LLC, Trustee for of Fidelity Bank, said Appointment of Substitute Trustee being recorded as Instrument# 20210012029 Book 2021 at Page 12029 of the records of the Chancery Clerk of said County; and,
WHEREAS, fee simple title is vested in Jimmy Ellis and Julia A. Ellis; and,
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, the legal holder of said indebtedness, Fidelity Bank, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expense of sale.
NOW, THEREFORE, Simpson Law Firm PA, Substituted Trustee in said Deed of Trust, will on the 16th day of December, 2021, offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the East Front Door of the Pearl River County Courthouse, in Poplarville, Mississippi, to the highest and best bidder for cash the following described property situated in Pearl River County, State of Mississippi, to-wit:
Commencing at a fence corner at the Southwest Corner of the Southwest Quarter of the Southwest Quarter of Section 12, Township 5 South, Range 17 West, Pearl River County, Mississippi; thence South 89 degrees 17 minutes 02 seconds East 99.0
feet to the Point of Beginning, said point being an existing rebar; thence North 00 degrees 42 minutes 58 seconds West 225.00
feet to a set rebar; thence North 89 degrees 30 minutes 03 seconds East ll84.60
feet to a set rebar on the west margin of C. D. Walker Road, a paved public road; thence South 00 degrees 42 minutes 57 seconds East 225.00
feet on and along an existing fence on said margin to an existing fence corner on the north margin of Byrd Road, a paved public road; thence South 89 degrees 30 minutes 03 seconds West 1184.60
feet on and along said margin to the point of beginning, containing 6.12
acres, more or less, and being a part of the Southwest Quarter of the Southwest Quarter of Section 12, Township 5 South, Range 17 West, Pearl River County, Mississippi.
