NOTICE OF SUBSTITUTE TRUSTEE’S SALE. STATE OF MISSISSIPPI, COUNTY OF PEARL RIVER. WHEREAS, on October 31, 2019, James Hines aka James D. Hines executed a Promissory Note payable to the order of Oceanside Mortgage Company its successors and assigns; and WHEREAS, the aforesaid Promissory Note was secured by a Deed of Trust dated October 31, 2019, executed by James Hines aka James D. Hines, an unmarried man and recorded in Book 2019, at Page 11365 of the records of the Chancery Clerk of Pearl River County, Mississippi; and which aforesaid Instrument conveys to Fidelity National Title Company, Trustee and to Mortgage Electronic Registration Systems, Inc. (“MERS”), as beneficiary, as nominee for Oceanside Mortgage Company its successors and assigns, as Beneficiary, the hereinafter described property; and WHEREAS, Mortgage Electronic Registration Systems, Inc. (“MERS”), as beneficiary, as nominee for Oceanside Mortgage Company its successors and assigns assigned said Deed of Trust to Oceanside Mortgage Company via an instrument dated May 2, 2022, and recorded in Book 2022, Page 4590 in the office of the Chancery Clerk of Pearl River County, Mississippi; and WHEREAS, Oceanside Mortgage Company appointed Marinosci Law Group, PC as Substitute Trustee in the place of the afore-mentioned original Trustee via an instrument dated November 4, 2022, and recorded in Book 2022, Page 11514 of the records of the Chancery Clerk of Pearl River County, Mississippi; and WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and WHEREAS, Marinosci Law Group, P.C., the Substituted Trustee in said Deed of Trust will on December 14, 2022, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the East front steps of the Pearl River Courthouse, located at 200 South Main Street, Poplarville, Mississippi, the following described property located and situated in Pearl River County, Mississippi, to wit: THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF Pearl River, STATE of MS, AND IS DESCRIBED AS FOLLOWS: LOT 17, SQUARE 101, PICAYUNE PARK SUBDIVISION AS PER OFFICIAL PLAT THEREOF ON FILE AND OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF PEARL RIVER COUNTY, MISSISSIPPI. Being and intending to be the same property conveyed from CHRISTIE L. KELLAR and ELI DAVID KELLAR to JAMES D. HINES by Deed, on September 21, 2018, Recorded in Book 2018, Page 9564 in the land records of the county of Pearl River, state of MS. Indexing Instructions: Lot 17 Square 101, Picayune Park Subdivision recorded in the office of Chancery Clerk of Pearl River County, Mississippi. More commonly known as: 53 OAK DR, PICAYUNE, MS 39466. Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand and gravel in or under subject property.
