SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, on the April 29, 2008, Darren W Merritt, Sr and Jenny Merritt, executed a Deed of Trust to Joan H. Anderson, Trustee for the use and benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for First Access Mortgage Corp., its successors and assigns, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Pearl River County, Mississippi, in Deed of Trust May 8, 2008, in Book No. 1434, at Page 401 thereof; which was modified on July 28, 2022, in Book No. 2022, at Page 7746 WHEREAS, said Deed of Trust was ultimately assigned to Freedom Mortgage Corporation by assignment on file and of record in the office of the Chancery Clerk of Pearl River County, Mississippi, in August 21, 2017, in Book No. 2017, at Page 7166 thereof; and WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted Wilson & Associates, PLLC, as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in January 3, 2023, in Book No. 2023, at Page 11 thereof; and WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness
secured and described by said Deed of Trust so to do, notice is hereby given that Wilson & Associates, PLLC f/k/a Adams & Edens, P.A., Substitute Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder for certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee, during the legal hours (between the hours of 11 o’clock a.m. and 4 o’clock p.m.) at the east door of the Pearl River County Courthouse, on February 24, 2023, the following described land and property being the same land and property described in said Deed of Trust, situated in Pearl River County, State of Mississippi, to-wit: All that certain real property situate in Pearl River County, Mississippi described as follows: Commencing at the Southeast corner of the Southeast Quarter of the Northwest Quarter of the Southeast Quarter of Section 22, Township 5 South, Range 17 West, Pearl River County, Mississippi, thence West 510.00 feet for the Point of Beginning; thence North 647.90 feet; thence West 150.00 feet; thence South 647.90 feet; thence East 150.0 feet to the Point of Beginning, this parcel containing 2.23 acres, more or less, and being a part of the Southeast Quarter of the Northwest Quarter of the Southeast Quarter of Section 22, Township 5 South, Range 17 West, Pearl River County, Mississippi. AND ALSO: A non-exclusive perpetual right-of-way or easement for access and utility purposes, on, over and across the following described real property, to-wit Commencing at the Southeast corner of the Southeast Quarter of the Northwest Quarter of the Southeast Quarter of Section 22, Township 5 South, Range 17 West, Pearl River County, Mississippi; thence West 465.48 feet for the Point of Beginning; thence North 20 degrees 10 minutes West 44.0 feet; thence West 30.0 feet; thence South 41.31 feet; thence East 44.95 feet to the Point of Beginning, this easement containing 0.035 acres, more or less, and being a part of the Southeast Quarter of the Northwest Quarter of the Southeast Quarter of Section 22, Township 5 South, Range 17 West, Pearl River County, Mississippi. AND ALSO: A non-exclusive perpetual right-of-way or easement for access and utility purposes on, over and across the following described real property to-wit. Commencing at the Northeast corner of the Southwest Quarter of the Southeast Quarter of Section 22, Township 5 South. Range 17 West, Pear River County, Mississippi; thence West 465.48 feet for the Point of Beginning; thence South 04 degrees 13 minutes East 366.60 feet to a point on the North edge of the Burgetown Public Road; thence South 56 degrees 27 minutes West along said road 34.32 feet; thence leaving road North 03 degrees 14 minutes West 384.32 feet; thence East 23.36 feet to the Point of Beginning, this easement containing 0.23 acres, more or less and being a part of the Southwest Quarter of the Southeast Quarter of Section 22, Township 5 South, Range 17 West, Pearl River County, Mississippi. Title to the above described property is believed to be good, but I will convey only such title as is vested in the aforementioned Substitute Trustee.
