WHEREAS, on May 5, 2003, Bonnie A. Koscinski, executed a certain deed of trust to D. J. Horecky, Trustee for the benefit of Bridges Mortgage, Div. of Central Bank for Savings, which deed of trust is of record in the office of the Chancery Clerk of Pearl River County, State of Mississippi in Book 1071 at Page 71, and Corrected Deed of Trust recorded in Book 1188 at Page 106; and
WHEREAS, said deed of trust was subsequently transferred and assigned to Standard
Mortgage Corporation by instrument dated May 5, 2003 and recorded in Book 1082 at Page 651 and again in Book 1188 at Page 125 of the aforesaid Chancery Clerk’s office; and
WHEREAS, Standard Mortgage Corporation has heretofore substituted Kent D. McPhail as Trustee by instrument dated May 11, 2023 and recorded in the aforesaid Chancery Clerk’s Office in Book 2023 at Page 4226 or as Instrument Number 2023004226; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Standard Mortgage Corporation, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expense of sale.
NOW, THEREFORE, I, Kent D. McPhail, Substituted Trustee in said deed of trust, will on June 21, 2023 offer for sale at public outcry through duly appointed auctioneer and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the East Door of the County Courthouse of Pearl River County, Mississippi, located at 200 South Main Street, Poplarville, MS 39470, to the highest and best bidder for cash the following described property situated in Pearl River County, Mississippi, to-wit:
Commencing at the Northwest Corner of the Southeast Quarter of Northwest Quarter of Section 35, Township 2 South, Range 16 West, thence run East 446 feet, thence run South 25 feet for a Place of Beginning; thence run South 477.4 feet, thence run East 214 feet, thence run North 502.4 feet, thence run West 115 feet, thence run South 60 degrees 15 minutes West 100 feet to the Place of Beginning; containing 2.40 acres, and being a part of the Southeast Quarter of
Northwest Quarter of Section 35, Township 2 South, Range 16 West, Pearl River County, Mississippi.
A part of the SE 1/4 of the NW 1/4 of Section 35, Township 2 South, Range 16 West, Pearl River County, Mississippi, and being more particularly described as follows: Commence at the SW corner of the SE 1/4 of the NW 1/4 of said
Section 35; thence North 1295.00 feet; thence East 446.00 feet to an iron pipe of the South margin of a paved public road, the Point of Beginning; thence South 0 degrees 23 minutes 07 seconds West 426.37 feet to an iron pipe; thence North 88 degrees 16 minutes 37 seconds East 255.02 feet to an iron axle, thence North 0 degrees 02 minutes 40 seconds West 425.28 feet to an iron rod on the South margin of a paved public road; thence along said road on the curve to the left, having a radius of 245.00 feet, an arc length of 264.45 feet, and a chord bearing South 88 degrees 30 minutes 00 seconds West 251.80 feet to the Point of
Beginning, containing 2.61 acres, more or less, in the above said Section, Township and Range.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
