NOTICE OF DEFAULT AND FORECLOSURE SALE
WHEREAS, on March 1, 2010, a certain Deed of Trust was executed by Milton Metaxas, as mortgagor or borrower, in favor of Genworth Financial Home Equity Access, Inc., as mortgagee or lender, and Mississippi Valley Title Insurance Company, as trustee, and was recorded in Book 1528 at Page 921 in the office of the Chancery Clerk of Pearl River County, Mississippi; and
WHEREAS, the Deed of Trust was insured by the United States Secretary of Housing and Urban Development (the “Secretary”), pursuant to the National Housing Act for the purpose of providing single family housing; and
WHEREAS, the beneficial interest in the Deed of Trust is now owned by the Secretary, pursuant to an Assignment of Deed of Trust dated April 11, 2018, and recorded in Book 2018 at Page 4032 in the office of the aforesaid Chancery Clerk; and
WHEREAS, a payment default has been made in the covenants and conditions of the Deed of Trust, and no payment has been made sufficient to restore the loan to currency; and
WHEREAS, the entire amount delinquent as of January 16, 2026, is $409,
513.30; and
WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Deed of Trust to be immediately due and payable and instructed the undersigned Foreclosure Commissioner to foreclose on the collateral securing the indebtedness.
NOW, THEREFORE, pursuant to powers vested in Underwood Law Firm PLLC by the Single Family Mortgage Foreclosure Act of 1994, 12 U.S.C. 3751 et seq., by 24 CFR part 27, subpart B, and by the Secretary’s designation of Underwood Law Firm PLLC as Foreclosure Commissioner by instrument recorded in Book 2025 at Page 1876, notice is hereby given that on April 22, 2026, between the hours of 11:00 a.m. and 4:00 p.m. prevailing Central Time all real and personal property at or used in connection with the following described premises (the “Property”) will be sold at public auction to the highest bidder for cash at the East Front Door of the Pearl River County Courthouse in Poplarville, Mississippi:
The South 2/3 of Lots 8, 9 and 10, Block 21, Williams-Goodyear Addition to the City of Picayune, Pearl River County, Mississippi, as per the official map or plat thereof on file and of record in the Office of the Chancery Clerk for Pearl River County, Mississippi.
Commonly known as: 500 Pine Street, Picayune, MS 39466.
The Secretary presently intends to bid $416,
687.31 and reserves the right to adjust its bid as necessary.
All funds must be submitted in the form of cash or a certificated check or cashier’s check made payable to Underwood Law Firm PLLC. If the Secretary is the highest bidder, the Secretary need not pay the bid amount in cash. The successful bidder will pay any and all conveyance fees and other costs associated with the transfer of title as well was all real estate and other taxes that are due on the Property.
There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the Property will be vacant.
The scheduled foreclosure sale shall be cancelled or adjourned if it is established that the default or defaults upon which the foreclosure is based did not exist at the time of service of this Notice of Default and Foreclosure Sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the Property is completed.
