PUBLIC NOTICE

SPECIAL COMMISSIONER’S NOTICE OF SALE

WHEREAS, on the April 26, 2021, Colton Kopszywa and Kelsey Kopszywa, executed a Deed of Trust to Cecil D. McCllellan, III, Trustee for the use and benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Planet Home Lending, LLC, its successors and assigns, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Pearl River County, Mississippi, in Deed of Trust Book No. 2021, at Page 5081 thereof;
WHEREAS, said Deed of Trust was ultimately assigned to Planet Home Lending, LLC by assignment on file and of record in the office of the Chancery Clerk of Pearl River County, Mississippi, on July 26, 2024 at Book 2024, Page 6702 thereof; and
WHEREAS, by Default Judgment dated February 24, 2026, and of record in the Office of the Chancery Clerk of Pearl River County, Mississippi on February 27, 2026 at Book 2026, Page 1917, it was ordered and adjudged that Planet Home Lending, LLC was the current holder of a good and valid lien on the subject property; that the indebtedness owed by the Defendants is in default; that the subject property should be sold to satisfy the indebtedness; and that Foundation Legal Group, LLP f/k/a Wilson & Associates, PLLC, as Special Commissioner was authorized to conduct the sale of the real property described herein; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that Foundation Legal Group, LLP f/k/a Wilson & Associates, PLLC Special Commissioner, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder for certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee, during the legal hours (between the hours of 11 o’clock a.m. and 4 o’clock p.m.) East Door off the Pearl River County Courthouse, 200 South Main Street, Poplarville, MS 39470, on May 13, 2026, the following described land and property being the same land and property described in said Deed of Trust, situated in Pearl River County, State of Mississippi, to-wit:
A parcel of land situated in Section 24, Township 2 South, Range 16W and more particularly described as follows: Commencing at the Point of intersection of the North margin of West Lamar Avenue with the Section line common to Section 19, Township 2 South, Range 15 West, and Section 24, Township 2 South, Range 16 West, Pearl River County, Mississippi: thence South 89 degrees 21 minutes West along said margin 122.30 feet for the Point of Beginning; thence South 89 degrees 21 minutes West along said margin 343.52 feet; thence leaving road North 00 degrees 18 minutes 22 seconds West 643.45 feet; thence North 89 degrees 41 minutes 16 seconds East 346.94 feet; thence South 641.43 feet to the Point of Beginning, this parcel containing 5.091 acres, more or less, and being a part of the Southeast Quarter of the Southeast Quarter of Section 24, Township 2 South, Range 16 West, Pearl River County, Mississippi.
Title to the above described property is believed to be good, but I will convey only such title as is vested in the aforementioned Special Commissioner.
