You have been made Defendants in the lawsuit filed in the Court by Plaintiff, Ben Barkley Smith, in his Complaint to Determine Heirs seeking to have the Court establish the heirs-at-law of Jesse T. Smith (Deceased) and seeking to adjudicate that the sole and only heirs-at-law of Jesse T. Smith (Deceased) are Gloria June Smith, a/k/a June Perkins Smith, Cindy Smith Brown, Steve Smith, Richard Smith, Robert Smith, Sue Kuhlmann, David Morris, Jesse Lee Morris, Johnny Morris, George Morris, Martha Baymiller, a/k/a Marti Baymiller, Lou Jones, Mike Murray, Jan Murray, James William Murray, Virgil Murray, Daniel Murray, Patrick Murray, Beth Smith Siegler, Bobby Smith, Fred Smith, Angela Smith Hoshman, Rex Witsell, Bill Witsell and Ben Barkley Smith.
IF TO BE FOUND IN THIS COUNTY, to be and appear before the Honorable Chase Ford Morgan of the Chancery Court of Pearl River County, Mississippi, to be held at the Pearl River County Chancery Courthouse on the 21st day of July, 2026, at 9:00 a.m. in Poplarville, Mississippi, next, then and there to show cause, if any they can, why should not be declared to be the sole heirs-at-law of Jesse T. Smith (Deceased), according to law.
YOU ARE SUMMONED TO APPEAR and defend against the Petition filed against you in this action on the date and time as set forth herein above before the Honorable Chase Ford Morgan in the Chancery Court of Pearl River County, in Poplarville, Mississippi; and in case of your failure to appear and defend, a judgment will be entered against you for the relief demanded in the petition.
You are not required to file an answer or other pleading, but you may do so if you desire.
